These Terms of Use govern your use of the Audio Book Choices app for iOS and Android and the Audio Book Choices pages on alekjaltuszyk.xyz.

1. Acceptance

By using Audio Book Choices, or by continuing after updated terms are presented, you agree to these terms. If you do not agree, do not use the app or the related Audio Book Choices website pages.

2. What Audio Book Choices Is

Audio Book Choices is an interactive “choose your story” audiobook app. You listen to AI-narrated stories and steer them with Yes or No choices, made by tapping the screen or, on iOS, by nodding your head with supported headphones. Each book is a branching story tree you can explore.

Features, stories, visuals, narration, input methods, and supported platforms may change over time.

3. Content And Licensing

The audiobooks, stories, narration, text, artwork, branding, and app are owned by or licensed to the Developer, except where otherwise stated.

Audiobooks and other content are licensed to you for personal, non-commercial listening within the app only. You may not copy, record, download outside the app, redistribute, publicly perform, broadcast, resell, sublicense, or create derivative works from the audiobooks or other app content, except where applicable law gives you a non-waivable right to do so.

Your license to access content is personal to you and may be limited, suspended, or ended if you misuse the app or content or breach these terms.

4. Free Testing Phase And Future Purchases

Audio Book Choices is currently in a testing phase. During this phase, book unlocks are provided free of charge. Free access during testing is temporary and provided as-is, and it may change, be limited, or end at any time.

We plan to introduce paid unlocks and subscriptions in the future. Any paid unlocks, subscriptions, prices, trials, billing, renewals, refunds, and taxes would be handled by the Apple App Store or Google Play under their own terms. We do not receive full payment-card details from those platforms. Purchase terms would be presented in the app and the relevant app store before any purchase.

Free access granted during testing does not guarantee free or continued access to any book after the testing phase ends.

5. Accounts And On-Device Data

Audio Book Choices does not require an account. Your listening progress, choices, unlocked books, and settings are stored on your device. Deleting the app may remove this local data, subject to normal iOS and Android backup and restore behavior. Privacy practices are described in the Audio Book Choices Privacy Policy.

6. Eligibility

Audio Book Choices is not directed to children under 13. If you are under the age of majority where you live, use the app only with parent or guardian permission where required. You may use Audio Book Choices only if you can legally agree to these terms. App store age ratings may vary by region.

7. AI-Generated Narration

Stories in Audio Book Choices are narrated using AI. AI narration and generated content may occasionally contain errors, unexpected phrasing, or content that does not match your expectations. Audio Book Choices is provided for entertainment and is not a source of factual, professional, medical, legal, or safety advice.

Audio Book Choices may rely on or link to third-party services, including the Apple App Store, Google Play, and website hosting providers. These services have their own terms and policies, which apply to your use of them. If you download the app through Apple’s App Store and no custom license agreement is provided, Apple’s Standard EULA applies to the app license.

10. Availability And Changes

We may add, change, suspend, remove, limit, or discontinue Audio Book Choices, individual books, features, the testing phase, or related website surfaces where reasonably needed to operate the app, comply with law or platform rules, protect users, or manage cost. Because the app does not use accounts, you may stop using it at any time by deleting it.

We may update these terms or the Privacy Policy from time to time. The version and effective date appear at the top of the relevant page and in the hosted legal manifest at https://alekjaltuszyk.xyz/apps/AudioBookChoices/legal-manifest.json. Continuing to use Audio Book Choices after updated terms become effective means you accept the updated terms, unless applicable law requires a different form of notice or consent.

To the fullest extent permitted by law, Audio Book Choices and related surfaces are provided on an “as is” and “as available” basis, without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, availability of any particular book, compatibility with every device, or that AI-narrated content will meet your expectations. Nothing in these terms limits rights, warranties, or remedies that cannot legally be limited or excluded under applicable consumer protection law.

13. Limitation Of Liability

To the fullest extent permitted by law, the Developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of Audio Book Choices. To the fullest extent permitted by law, our total aggregate liability for claims arising out of or related to Audio Book Choices will be limited to the greater of the amount you paid us directly for the app in the 12 months before the claim or EUR 25. Nothing in these terms limits liability that cannot legally be limited or excluded.

14. Governing Law

These terms are intended to be governed by the laws of Poland, except where mandatory consumer protection, platform, or local law gives you rights that cannot be waived or changed by contract.

15. Severability

If any part of these terms is found invalid or unenforceable, the remaining parts continue to apply to the fullest extent permitted by law.
