These Terms of Use govern your use of the OverLit iPhone app, the OverLit pages on alekjaltuszyk.xyz, support, ads, and related surfaces that link to these terms.

These terms cover:

1. Acceptance

By using OverLit, you agree to these terms. If you do not agree, do not use the app or related OverLit website and support surfaces.

2. Apple Standard EULA

If you download OverLit through Apple’s App Store and no custom end user license agreement is provided in App Store Connect, Apple’s Standard EULA applies to the app license.

These Terms of Use govern OverLit-specific app, website, support, advertising, and related behavior.

3. What OverLit Is

OverLit is a short-session arcade/reflex game. A grid of cells lights up, heats toward red, and burns out; the player taps active cells before any one burns out.

Features, visuals, copy, ad behavior, and availability may change over time.

4. Eligibility

OverLit is not directed to children under 13, and children under 13 should not use OverLit. If you are 13 or older but under the age of majority where you live, use OverLit only with parent or guardian permission where required.

5. Gameplay Safety

OverLit is a fast reflex game with flashing, color, motion, and time-pressure feedback. Stop playing if you feel uncomfortable, dizzy, strained, or otherwise unwell.

Use device accessibility settings where they are helpful for your comfort and safety.

6. Ads, Full Version, And Rewarded Unlocks

The free experience of OverLit may show Google AdMob rewarded ads, Google AdMob interstitial ads, and local developer house ads for the Developer’s own apps. Rewarded ads are opt-in value trades for eligible theme unlocks or level-skip offers. Interstitial ads may appear only at safe menu or replay breaks, not during active gameplay.

OverLit uses Google User Messaging Platform / AdMob privacy messages where required, including European regulations messages, U.S. state privacy regulation messages, and an AdMob IDFA explainer before Apple’s App Tracking Transparency prompt where applicable. If you decline consent or tracking permission, ads may still be unavailable, contextual, non-personalized, limited, or replaced by local house ads according to Google/AdMob, Apple, and applicable law.

Ad availability, ad loading, and rewards are not guaranteed. Rewarded unlocks may be unavailable, delayed, interrupted, or changed.

OverLit may offer an optional one-time non-consumable in-app purchase called Full Version. Full Version is processed by Apple through the App Store. It is not a subscription and does not require a custom OverLit account.

When active, Full Version removes normal in-app ads, unlocks ad-gated themes, and lets existing level-skip offers complete without watching an ad, subject to the app’s normal daily skip limits. Full Version does not automatically unlock progression-only rewards, arcade modes, or other non-ad content that still requires normal gameplay.

Purchases, restorations, refunds, billing, and payment methods are handled by Apple and the App Store under Apple’s own terms and policies. The app may store local entitlement state and limited StoreKit transaction metadata so it can remember and restore a verified purchase.

Ads shown in or for OverLit, including local developer house ads, should be appropriate for OverLit’s app age rating. If you see an inappropriate or age-inappropriate ad, contact support with a short description and any useful context.

Full Version is intended to remove normal in-app ads from OverLit while the entitlement is active. It does not remove ads, promotions, or tracking that may appear on third-party websites, the App Store, external ad platforms, or other destinations you open outside OverLit.

7. Privacy

OverLit privacy practices are explained in the OverLit Privacy Policy.

8. Local Progress

High scores, settings, unlocks, play counters, and legal acceptance state may be stored locally on your device so the app can work normally and remember your choices.

Deleting the app may remove local app data from the device, subject to normal iOS backup, restore, and device behavior.

10. Suspension, Termination, And Availability

Because OverLit does not use accounts or a custom backend, we usually cannot suspend a local player account. We may still stop providing, update, remove, block, or limit access to OverLit, related website surfaces, support channels, ad placements, or features where reasonably needed to operate the app, comply with law or platform rules, protect the app or users, respond to misuse, or end support for a feature.

You may stop using OverLit at any time. Deleting the app may remove local app data from the device, subject to normal iOS backup, restore, purchase, and device behavior.

11. Intellectual Property

The app design, copy, branding, visuals, website, and related materials are owned by or licensed to the Developer except where otherwise stated.

You may not copy, reproduce, redistribute, or exploit those materials except as allowed by law or with permission.

12. Third-Party Services

OverLit and related surfaces may link to or rely on third-party services, including Apple, Google/AdMob, email providers, website hosting, App Store links, and external destinations.

Third-party services have their own terms and policies. We do not control those services and are not responsible for their content, availability, policies, or practices.

13. No Professional Advice

OverLit is a game. It is not legal, medical, therapeutic, financial, emergency, or other professional advice.

14. Disclaimers

To the fullest extent permitted by law, OverLit and related surfaces are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, ad availability, rewards, scores, compatibility, or fitness for a particular purpose.

15. Limitation Of Liability

To the fullest extent permitted by law, the Developer will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of OverLit, the website, ads, support, or third-party services.

Nothing in these Terms limits or excludes any rights, warranties, remedies, or liabilities that cannot be limited or excluded under applicable consumer protection law.

16. Governing Law

These Terms are governed by the laws of Poland, except that this choice of law does not limit any mandatory consumer protection rights or other mandatory laws that apply where you live. If you are a consumer, you may bring claims in the courts and forums available under applicable law.

17. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue to apply to the fullest extent permitted by law. The invalid or unenforceable part will be interpreted or replaced in the closest lawful way that matches its original purpose.

18. Assignment And Transfer

You may not transfer your rights or obligations under these Terms unless applicable law gives you that right. We may transfer or assign these Terms, OverLit, or related rights and obligations in connection with operating the app, a business transfer, merger, acquisition, reorganization, asset sale, legal requirement, or similar event, as long as this does not remove mandatory rights you have under applicable law.

19. Changes To These Terms

We may update these terms from time to time. When we do, we will update the effective date and version above.
