Take Me Somewhere Terms of Service

These Terms of Service govern your use of the Take Me Somewhere website pages on alekjaltuszyk.xyz, support channels, App Store surfaces, and product-specific app behavior that is not already covered by Apple’s Standard EULA.

Take Me Somewhere is provided by Aleksander Jałtuszyk (“Developer”, “we”, “us”, or “our”). Country: Poland. Contact: alekgameshelp2@gmail.com.

These terms are intended to be easy to update as Take Me Somewhere changes. They cover:

1. Acceptance

By using Take Me Somewhere, tapping to accept, or continuing after updated terms are presented, you agree to these terms. If you do not agree, do not use the app or related Take Me Somewhere website and support surfaces.

2. Apple Standard EULA

If you download Take Me Somewhere through Apple’s App Store and no custom end user license agreement is provided in App Store Connect, Apple’s Standard EULA applies to the app license. Apple’s Media Services Terms and Conditions may also apply to App Store download, purchase, refund, family sharing, and platform account behavior.

These Terms of Service are supplemental product terms for Take Me Somewhere-specific website, support, route suggestion, safety, privacy, acceptable-use, and related behavior. They do not replace Apple’s Standard EULA for the App Store app license. If these terms conflict with Apple’s Standard EULA, App Store rules, or mandatory law, the Apple or mandatory-law terms control for that issue.

3. What Take Me Somewhere Is

Take Me Somewhere is a lightweight local exploration companion. It helps you choose a time budget, choose a vibe or destination, and receive a nearby suggested route, destination, map view, or compass-guided outing.

Features, visuals, copy, route behavior, provider availability, supported regions, and supported travel modes may change over time. Walking is the first intended travel mode, with riding and driving possible in future versions.

4. Eligibility

Take Me Somewhere is intended for users who are at least 13 years old. Children under 13 may not use the app, website, or support surfaces.

If you are 13 or older but under the age of majority where you live, use Take Me Somewhere only with parent or guardian permission where required. You may use Take Me Somewhere only if you can legally agree to these terms and legally consent to location use where required.

Because Take Me Somewhere has a 13+ minimum age, the App Store listing may use an age-rating override where Apple requires the rating to match a minimum-age term.

5. Routes, Compass, Maps, And Safety

Take Me Somewhere is for casual exploration. It is not an emergency service, professional navigation service, safety system, transportation authority, accessibility assessor, health or fitness service, or substitute for your own judgment.

Routes, destinations, compass direction, map display, progress, estimated time, distance, place information, and related guidance are suggestions only. They are intended to help you decide where you might go for a fun local outing. They are not instructions that must be followed.

You are responsible for deciding whether any suggested route, direction, street, crossing, path, trail, place, venue, or outing is safe, lawful, accessible, open, and appropriate for you. Before and during an outing, you should use your own judgment, check real-world conditions, follow posted signs, obey traffic laws, respect private property and closures, and follow instructions from authorities.

Actual conditions may differ from what the app, map, compass, route, provider data, or estimated progress shows. Roads, sidewalks, paths, trails, crossings, venues, lighting, weather, construction, closures, traffic, terrain, crime risk, accessibility, opening hours, and other conditions can change or be represented incorrectly.

Do not use or rely on Take Me Somewhere where inaccurate, delayed, unavailable, or misunderstood route or location information could lead to death, personal injury, property damage, legal violations, trespass, missed transport, getting lost in unsafe conditions, or another serious consequence.

Stop using the app if looking at it, following it, or interacting with it would distract you or create risk, including while driving, riding, crossing streets, moving through traffic, or entering unfamiliar areas.

6. Spatial Truth And AI

Take Me Somewhere is designed so route geometry, ETA, distance, bearing, map display, and route feasibility come from deterministic app logic and map or routing providers, not from AI-generated directions.

The app does not currently use managed AI services. If AI assistance is introduced or enabled later, it should be limited to tasks such as understanding intent, explaining candidates, or recommending among app-scored options. AI output may still be incomplete or wrong. Do not treat AI text as route truth, safety advice, legal advice, or official place status.

7. Privacy

Take Me Somewhere privacy practices are explained in the Take Me Somewhere Privacy Policy.

Location data is sensitive. Review iOS permission prompts, iOS location settings, and the Privacy Policy before using route features.

Take Me Somewhere may store local preferences, route settings, optional recent-destination memory, and legal acceptance state on your device so the app can work normally and remember your choices.

Recent-destination memory is meant to avoid repeating places. It should remain local-first and optional. Deleting the app may remove local app data from the device, subject to normal iOS backup, restore, and device behavior.

9. Third-Party Services And Map Providers

Take Me Somewhere may use or link to third-party services, including Apple MapKit, Apple Local Search, Apple Maps, OpenStreetMap-derived services, Overpass endpoints, App Store services, email providers, website hosting providers, and external websites.

Third-party services have their own terms and policies. We do not control third-party maps, routes, place databases, opening hours, reviews, ratings, road or trail data, traffic information, outages, provider rules, or external websites.

You must not use Take Me Somewhere in a way that violates third-party service terms, provider attribution requirements, map-data licenses, App Store rules, Apple’s Standard EULA, or applicable law.

Provider choices may vary by build, configuration, region, feature, or future version. The current product direction is OpenStreetMap-derived place discovery with Apple fallback discovery, Apple routing, Apple map display, and Apple Maps handoff.

10. Accounts And Purchases

Take Me Somewhere does not currently require an account or paid subscription. If accounts, paid features, subscriptions, trials, or one-time purchases are added later, the app and App Store metadata should explain the relevant purchase terms before purchase.

Purchases, refunds, billing, taxes, family sharing, purchase history, and payment methods are handled by Apple or the relevant platform provider. We do not receive full payment-card details from Apple.

11. Support

Support is available by email through the support page. We may ask for details such as your device model, OS version, app version, what you were trying to do, what happened, and any relevant route context.

We try to provide helpful support, but we do not guarantee response times, availability, bug fixes, feature changes, route corrections, map-provider corrections, or compatibility with every device, OS version, region, or provider.

13. Your Content And Feedback

You keep your rights in support messages, feedback, screenshots, route descriptions, or other content you choose to send us. You give us permission to use that content as reasonably needed to respond, troubleshoot, improve reliability, protect the service, comply with law, and enforce these terms.

If you send ideas, suggestions, or feedback, you allow us to use them without restriction or compensation, unless we separately agree otherwise in writing.

14. Intellectual Property

The app design, code, copy, branding, visual style, website, and related materials are owned by or licensed to the Developer except where otherwise stated.

Map data, place data, provider marks, platform marks, Apple marks, OpenStreetMap data, and third-party content remain owned by their respective owners and may be subject to separate licenses, terms, attribution requirements, and usage restrictions.

Nothing in these terms grants you rights to use our branding, provider branding, map data, app code, website code, or third-party content except as allowed by these terms, Apple’s Standard EULA, provider terms, or applicable law.

15. Availability, Changes, And Termination

We may add, change, suspend, remove, block, limit, or discontinue Take Me Somewhere, related website surfaces, support channels, providers, supported regions, supported travel modes, or features where reasonably needed to operate the app, comply with law or platform rules, protect users, respond to misuse, manage cost, or end support for a feature.

Because Take Me Somewhere does not currently use accounts, we usually cannot suspend a local user account. You may stop using Take Me Somewhere at any time and may delete the app from your device.

We may update these terms or the Privacy Policy from time to time. The version and effective date appear at the top of the relevant page and in the hosted legal manifest at https://alekjaltuszyk.xyz/apps/TakeMeSomewhere/legal-manifest.json.

If a legal document changes, the app may require you to review and accept the current document versions before continuing. Continuing to use Take Me Somewhere after updated terms become effective means you accept the updated terms, unless applicable law requires a different form of notice or consent.

If a future app version introduces materially different data handling, accounts, paid features, background location, cloud route history, advertising, analytics, or managed AI processing, the public legal documents should be updated before those changes are used.

17. Disclaimers

To the fullest extent permitted by law, Take Me Somewhere and related surfaces are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, route availability, provider availability, compatibility, accuracy, safety, accessibility, or fitness for a particular purpose.

We do not guarantee that routes, destinations, compass direction, maps, places, distances, ETAs, progress, opening status, provider data, AI text, or app suggestions will be accurate, current, safe, lawful, accessible, complete, or suitable for you.

Nothing in these terms limits rights, warranties, remedies, or liabilities that cannot legally be limited or excluded under applicable consumer protection law.

18. Limitation Of Liability

To the fullest extent permitted by law, the Developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of Take Me Somewhere, route suggestions, maps, Compass Mode, Route Mode, provider data, website surfaces, support, or third-party services.

To the fullest extent permitted by law, our total aggregate liability for claims arising out of or related to Take Me Somewhere will be limited to the greater of the amount you paid us directly for Take Me Somewhere in the 12 months before the claim or EUR 25.

Nothing in these terms limits or excludes liability that cannot legally be limited or excluded, including liability for intentional misconduct or rights that applicable consumer law gives you and does not allow contracts to waive.

19. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising out of or related to your misuse of Take Me Somewhere, your breach of these terms, your violation of law or third-party rights, your route decisions, or content you send through support or related channels.

This section does not apply where prohibited by applicable consumer-protection law.

20. Governing Law And Consumer Rights

These terms are intended to be governed by the laws of Poland, except where mandatory consumer protection, platform, or local law gives you rights that cannot be waived or changed by contract.

If you are a consumer, you may have rights to bring claims in the courts and forums available under applicable law.

21. Severability

If any part of these terms is found invalid or unenforceable, the remaining parts will continue to apply to the fullest extent permitted by law. The invalid or unenforceable part will be interpreted or replaced in the closest lawful way that matches its original purpose.

22. Assignment And Transfer

You may not transfer your rights or obligations under these terms unless applicable law gives you that right. We may transfer or assign these terms, Take Me Somewhere, or related rights and obligations in connection with operating the app, a business transfer, merger, acquisition, reorganization, asset sale, legal requirement, or similar event, as long as this does not remove mandatory rights you have under applicable law.
